Dear Sir:

We are a statewide, grassroots non-profit organization. Our purpose is to ensure that our immigration laws are being enforced in North Carolina. Currently we have over 6,000 North Carolina citizens or legal residents as members.

It has come to our attention that you may be in violation of federal immigration laws. From the reports we have received, there is a distinct possibility that you are currently employing illegal aliens.

Employing illegal aliens in North Carolina is a federal crime; punishable by fines up to $3,000 per unauthorized alien, imprisonment up to six months in jail, or both.

Not only that, but the I.R.S. does not take kindly to employers avoiding employee withholding taxes. Penalties for willful failure to collect, truthfully account for and pay, the withheld income taxes and employee's share of FICA, amount to $500 per unauthorized employee.

It would be prudent on your part, to ensure that all of your employees are legally eligible to work. One way to do this is to use the Government’s free E-Verify system to verify the Social Security number of every employee.

It can be very costly to employ illegal aliens in North Carolina. In this depressed economic time, we certainly wouldn’t want to see any business negatively impacted by reporting them to I.C.E. and the I.R.S.

One more question to consider is, with unemployment in North Carolina at over 10%, how many of these positions could be filled by our law abiding citizens, instead of by someone who is breaking the law?
